the exerience of today.. police station visit

of course.. everything I do ends up to be an experience .. be it a weird one or a regular one.. I usually turn it to the first :)

today, my striking experince was a visit to Kasr el nil police station... I needed to do an illogical procedure.. which is to get a note that my passport that was issued in 1986 and expired since 1993 has been lost! first.. I am not sure it's been lost in the first place.. the only thing I'm confident of that I've no idea where it is .. but in order to issue a new passport, I will need this memo from any police station.

due to the fact that I'm being spoilt, I avoid dealing with people in any service unless i have to.. honestly, this time I was going to push mum to do it.. but luckily I found a friend who was willing to join me in my endeavour to get the memo.

we agree that we will meet at the police station. I arrived before him. here's what I saw; a convention around the police station... so many people .. I know that usually around police station we may find few people who may have a relative in detention .. but this time the number was huge. when we asked what's going on, we were told they've relatives arrested because of the events that took place around the US embassy in Cairo.

it then struck me.. why did we choose the police station closest to the Embassy.. no idea... but, the Station was working.. so it was ok...

my friend arrived and when I left the car walking to the station my driver wanted to escort me :) he was worried that I walk alone among the people.. so I objected.. I told him.. we are still in our country.. I can manage...which I did :)

stepped into the station, it was an old palace or smthg.. the ceilings were very high and the architecture showed old richness to the building... this added a medieval flavour to the experience :)

the hall was full of people but not a suffocating number.. lawyers... human rights'activists.. and what was striking was a voice saying he has no partner in a very loud desperate voice 'la sharik laho'.. I looked to find the source but failed to see the person.. there were few people around him and he was persistent in repeaing the same words...

still curious to figure out what was taking place and failing, I went intothe office of the chief in order to get my memo.

he was a nice guy and he had two human rights' activists sitting with him... whenever the door was opened, we hear the same guy with the same tone repeating the same words.. so my friend joked and said , he is not being beaten.. don't worry the human rights people are around., I can guarantee that he is not being subjected to torture..I said I'm just curious why he keeps going..

I finished my memo, thanked the chief and while leavng and the same voice was really giving me an urge to see what was going on... and finally I saw the guy.

stereo type in this case, I expected to see a guy in galabya, turban and beard.. however, I found out it's a regular sized guy in pants and a shirt who was lying down on the floor in a corner and still repeating the same words in the same tone ... he was not even under arrest to be subjected to anything... and he was just lying down there, curled in a baby style sleep and continuously saying la sharik laho...

I still failed to understand why he is doing thit.. but I was positive that he was not subjected to any I'll treatment...


I have so many controversial feelings towards my experience ... but one thing was good.. I got my stupid memo in my hand when I left the station..so, I can proceed with the rest of the procedures.:)

نجلا وفا .... قضية بين الامل والواقع

هالنى وافزعنى ما نشر حول قضية المواطنة المصرية نجلا وفا والتى حكم عليها بالجلد فى المملكة العربية السعودية بسبب خلاف بينها وبين اميرة سعودية.
اول إشكالية تثيرها هذه المسألة هى حماية حقوق المصريين فى الخارج على اعتبار انها واجب سياسي وقانونى على الدولة، وقد قدمت السياسى على القانونى لان البعد السياسى هو الأعظم تأثيراً على البعد القانونى الذي يضع قيوداً على هذا الدور. وفيما يخص قضية نجلا وفا- على الرغم من فقر المعلومات فى هذا الشأن- وما نشرته الصحف من انتقاد لدور الخارجية المصرية بسفاراتها وقنصلياتها فى المملكة لعدم تدخلها فى وقف تنفيذ حكم الجلد، يجب عينا التنويه بحدود هذا الدور؛  فعلى الرغم من ضرورة عدم الإدعاء بأن عمل مؤسسات الدولة لا غبار عليه، بما فيها الخارجية، ولكن علينا التنويه بحدود دورها فى الخارج، فمن الناحية القانونية وفقاً للعرف الدولى واتفاقية فيينا للعلاقات القنصلية لا يحق للمثل الدولة التدخل فى سير المحاكمات أو وقف تنفيذ الأحكام الصادرة من قضاء أجنبى ضد مواطنيها، ولكن يحق له متابعة المحاكمة لضمان سير إجراءاتها وفقاً لمبادئ العدالة وكفل حق الدفاع للمواطن المتهم.
 
أما من الناحية السياسية، فيمكن إثارة الأمر مع مسئولى الدولة الأجنبية ليس فقط لضمان سير العدالة ولكن يمكن ان يصل إلى الإفراج عن المواطن لأسباب سياسية، وهو ما يتطلب تدخلاً رفيع المستوى أعلى من مؤسسة الخارجية ذاتها، كما حدث للأسف فى قضية المنظمات غير الحكومية الأمريكية، أو الإفراج عن المدان فى مقابل الإفراج عن مواطنين أو لتحقيق مكاسب سياسية على غرار عزام عزام الجاسوس الإسرائيلى.
وهنا لا يسعنا إلا التأكيد على انه فى حالة استمرار غياب تفاصيل القضية، يصعب علينا إصدار أحكاما مسبقة حول وضع المواطنة المصرية فى القضية، ولكن من الناحية السياسية علينا أن نشدد على أن السعى للحصول على قروض من دول الخليج يجب ألا ياتى على حساب المواطن المصرى العامل هناك، لذلك نناشد رئيس الجمهورية بالتدخل لوقف حكم الجلد على هذه السيدة، خاصة وأن الخلاف مع أميرة سعودية، وبالتالى فيحتاج الأمر إلى تدخل على هذا المستوى السياسى دون غيره.
أما الإشكالية الأخرى الواجب معالجتها والتى لا تنفصل عن هذا السياق تنصب فى ضرورة دعم قنصلياتنا فى الخارج لتعزيز قيامها بواجبها فى حماية حقوق المصريين فى الخارج بدلاً من الهجوم عليها سواء كانت مصيبة أم مخطئة، فلم يعترف أحد بالجهود التى بذلتها وزارة الخارجية ممثلة فى بعثاتها فى ليبيا أثناء عملية ترحيل المواطنين المصريين هناك أثناء الثورة الليبية وتحت قصف الناتو والتى كانت تتم فى ظروف غاية فى الصعوبة وتتعدى طاقات تلك البعثات بل الدولة ككل بسبب أعداد المصريين المتواجدين هناك، ومن جانب آخر تقتدى معالجة هذه المسألة إرادة سياسية حقيقية من القيادة السياسة فى مصر لحماية المواطن المصرى فى الخارج وإصدار وإنفاذ قوانين صارمة لسفر المصريين للعمل فى الخارج بشكل يضمن الحد الأدنى من حقوقهم فى التعاقد فى ظل الظروف الإقتصادية الصعبة التى تدفع الكثير للسعى للرزق خارج البلاد.
وفى النهاية، وإلى أن يتغير الوضع القائم يجب وضع معايير واضحة لعمل الأجانب فى مصر وإعطاء الأولوية للعمالة المصرية طالما توافرت الخبرات المطلوية فى السوق المحلى وضوابط للسفر للبلاد التى لا تحمى قوانينها حقوق العمالة الواردة إليها، أى ببساطة تحقيق جزء من الحماية قبل أن تقع الفاس فى الراس.
